This is not an exemption and not a deferral. It is a waiver of penalty and interest on tax that came due while you were serving out of state.

Who it covers

  • You are on active duty and were transferred out of Texas.
  • A reservist called up and transferred out counts too.
  • It applies to property you own — the delinquency is the tax that fell due while you were away.

The 60 days, and when they start

You get 60 days, counted from whichever of these happens first: you are discharged, you come back to Texas for more than 10 days, or you return to non-active reserve status. The form is 50-305 and it goes to the tax office or the appraisal district — never to the Comptroller.

Filing the notice is not what makes you eligible

The statute says plainly that failing to file the notice does not affect your eligibility. File it anyway so the collector knows — but the right does not depend on the paperwork.

Two things in wide circulation are out of date

Both were changed in 2019, and official pages still print the old version

You do not need a declared war or national emergency. That condition was removed from the law in 2019. Several official pages — including Harris County's own military page and an old copy of the form — still show the version with it in.

And missing the 60 days is not the disaster it is described as. The widely published warning is that penalty and interest then apply to the whole delinquency. The same 2019 bill capped it at 6% a year with no penalty. That is better than ordinary delinquency, and we could not find it stated on any official page.

Common questions

Does this cancel the tax?

No. The tax is still owed. What is waived is the penalty and the interest that would otherwise pile on top of it while you were serving out of state.

I missed the 60 days. Have I lost it?

No, and the warnings you will read elsewhere are out of date. Missing the window means the balance carries 6 percent a year with no penalty — far better than ordinary delinquency. Do not let a stale page talk you into thinking it is hopeless.

Do I need a declared war for this to apply?

No. That condition was removed from the law in 2019, although several official pages still print the older version that includes it.
